Please read these Terms & Conditions ("Terms") carefully before using Parking Planner (the "Service"), operated at parkingplanner.com.au (the "Site") (ABN 71 245 313 072) ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. What Parking Planner Is

Parking Planner is an online tool that generates indicative parking layouts based on site dimensions, boundaries, and configuration options you provide. It is intended for preliminary feasibility and concept planning purposes only.

Generated layouts are indicative and must not be relied upon as detailed engineering design, planning approval, compliance certification, or professional advice. You are responsible for independently verifying applicable legislation, planning requirements, local authority requirements, site conditions, and relevant design requirements before relying on any output from the Service. We do not guarantee that a generated layout will satisfy all applicable requirements for any particular site or development.

2. Accounts

To use the Service, you need to create an account. You're responsible for:

Each account is for use by a single person. Accounts are not to be shared between multiple users.

3. Plans, Billing & Cancellation

Free Plan. The Free Plan allows a limited number of layout generations per day, and includes a watermark on generated outputs. Free Plan limits may be changed at our discretion.

Pro Plan. The Pro Plan is a paid subscription billed on a recurring basis (currently monthly) via our payment processor, Stripe. By subscribing, you authorise us to charge your nominated payment method on each billing cycle until you cancel.

Cancellation. You may cancel your Pro Plan subscription at any time. Cancellation takes effect at the end of your current billing period — you'll retain Pro access until then, and won't be charged again afterward.

Refunds. Payments already made for a billing period are non-refundable, including where you cancel partway through a period — you'll retain access until the period ends, as above. This does not affect any rights you may have under the Australian Consumer Law (see Section 6).

Price changes. We may change subscription pricing from time to time. Where reasonably practicable, we'll provide notice before a price change takes effect for existing subscribers.

The Service, including its software, design, layout-generation engine, and content (excluding content you input, such as site dimensions), is owned by us and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you.

Layouts generated for your own site inputs are yours to use for your own purposes, including in reports, submissions, or client deliverables — subject to the disclaimers in Section 1 regarding their indicative nature.

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we make no warranties, express or implied, regarding:

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service — including but not limited to costs arising from reliance on a generated layout for purposes beyond preliminary feasibility and concept planning.

Where liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the Service or the cost of re-supplying the Service.

8. Service Availability & Changes

We may modify, suspend, or discontinue any part of the Service at any time, including features available on the Free or Pro Plan. We'll aim to give reasonable notice of material changes affecting paying subscribers where practical.

9. Termination

We may suspend or terminate your account if you breach these Terms, including the Acceptable Use provisions in Section 4. You may stop using the Service and close your account at any time; see Section 3 regarding subscription cancellation specifically.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in relation to any dispute arising from these Terms or your use of the Service.
